1. Confidentiality

Engagement: LAP Studios commits to uphold confidentiality in all communications and transactions with you. Any personal data and transaction details shared on this website will be protected and will not be shared with third parties, except as required by law or to fulfill service delivery obligations.

2. Protection of Buyer Information

Commitment to Confidentiality: LAP Studios recognizes the importance of maintaining the confidentiality of our buyers. We are committed to ensuring that all information related to the buyer, including personal details, transaction history, and any other related data, remains strictly confidential.

Non-disclosure: We will not disclose, distribute, or share any information about the buyer to third parties unless required by law or with the explicit consent of the buyer.

Data Security: We employ advanced security measures to protect the buyer's information against unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to, secure servers, encrypted communications, and regular reviews of our data collection, storage, and processing practices.

Limited Access: Access to buyer information within LAP Studios is restricted to employees, contractors, and agents who need to know that information to process it for us. These individuals are bound by strict confidentiality obligations and may be subject to discipline, including termination, if they fail to meet these obligations.

Review and Correction: Buyers have the right to review their information stored with us and can request corrections or deletions as necessary.

Exclusion to Confidentiality Commitment: Notwithstanding the above, if a buyer initiates a credit chargeback or engages in actions that result in financial disputes or losses to LAP Studios, we reserve the right to not honor the non-disclosure agreement in order to recover our costs or defend our rights. This may involve sharing relevant buyer information with financial institutions, legal entities, or other necessary parties.

Updates to this Commitment: We may occasionally update this confidentiality commitment to reflect changes in our practices and services. When we post changes to this statement, we will revise the "last updated" date at the bottom of this statement.

3.Refund Policy

No Refunds After File Transfer: Once all files related to your purchase have been sent to you, all sales are deemed final, and no refunds will be provided.

Mistaken Purchases: In the event of an inadvertent or mistaken purchase, and if a refund request is made before the transfer of files, a 5% fee will be deducted from the refund amount to cover the non refundable payment gateway fees.

4. Usage of Purchased Tracks

Exclusivity and Restrictions: When you purchase a track from LAP Studios, you are granted exclusive rights for personal use and release. Redistribution, resale, or repackaging of the track, whether as sample packs, project templates, or any format that permits third-party access to the samples, MIDI, or project files, is strictly prohibited. Any violation of these terms can lead to legal actions.

Rights Under Exclusive License: When you purchase a track from LAP Studios, you obtain a broad set of rights under an exclusive, perpetual license. These rights include:

• Representing the track under your name, pseudonym, brand, or other designation.
• Showcasing the track on streaming platforms such as Spotify, Apple Music, Tidal, among others.
• Entitlement to all royalties earnings generated by the track.

5. Custom Ghost Production

Confidentiality of Demos: Users are strictly prohibited from sharing on social media or any other platforms any free demos provided by LAP Studios during the custom ghost production process.

Ownership: Until full payment of our fee has been made, LAP Studios remains the sole owner of the music produced, regardless of any contributions from the user. Upon completion of the transaction and full payment, the intellectual property rights will be transferred to the client, unless otherwise specified in a separate agreement.

Discretionary Collaboration: LAP Studios reserves the right to choose projects at our sole discretion. We are not obligated to undertake every custom ghost production request and can decline projects based on our assessment and capacity.

Collaboration Assessment: While we value each of our clients and strive for a harmonious collaboration, there may be instances where the collaboration may not align with our creative or professional standards. In such cases, LAP Studios reserves the right to discontinue the collaboration at any stage of the production process.

Termination of Collaboration: If, during the course of a project, we determine that the collaboration is not progressing in a mutually beneficial manner, or if there are repeated challenges that hinder the production process, LAP Studios may choose to terminate the collaboration. In such cases, any prior agreements regarding refunds or deliverables will be honored as per the initial agreement.

Communication: We believe in open communication. Should any concerns arise during the collaboration, we will communicate these to the buyer in a constructive manner, aiming for a resolution that benefits both parties.

6. Liability

Limitation of Liability: By purchasing music from LAP Studios, you agree to use it lawfully and ethically. LAP Studios is not responsible or liable for any damages, legal actions, or any other consequences you might face as a result of using the purchased music. It is your responsibility to ensure that your use of our products complies with all applicable laws and does not infringe on the rights of others.

7. Miscellaneous

Amendments: LAP Studios reserves the right to modify these Terms of Service at any time, and such modifications will be effective immediately upon posting the modified Terms of Service on the website.

Governing Law: These terms and conditions are governed by and construed in accordance with the laws of France and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
